UNDER THE U.S. DEPARTMENT OF LABOR’S

TEMPORARY EMPLOYMENT CERTIFICATION PROGRAM

 

An application concerning the employment of one or more alien (4) workers for the following temporary positions will be filed with the Department of Labor. This Notice of Filing will be posted for 15 consecutive business days, as directed by the U.S. Department of Labor.

 

Position Title: Construction Laborers                 

 

Position Duties: Perform temporary and full-time job duties as follows: Cleaning and preparing job sites (parking lots, driveways, etc.) for asphalt, paving and maintenance. May dig trenches. May use equipment such as plate compactors, asphalt distributors, air hammers, shovels and other small equipment.

 

Job is located in Edwards, Colorado. Light travel, employer provides transportation from workplace to/from all job sites. Job sites may include: Eagle, Garfield, Pitkin, Routt, Grand and Summit counties. 

 

Rate of Pay:    $19.12/hour + DOE (The employer will pay or exceed the prevailing wage, as determined by the US Dept of Labor).

Hours per Week: 35. (OT is possible, to be paid at $28.68/hour + DOE).

 

Single workweek will be used to compute wages due. Workers will be paid every two weeks by checks. All deductions from the worker’s paycheck required by law will be made.

Work hours: 35 hrs/wk. 9AM-5PM. Work week is Monday-Sunday.

 

No education, experience or training required. On-the-job training will be provided.  

 

Clean driving record and current driving license required. 

 

Possible loan assistance program. Possible bonus, depending on performance. 

 

Transportation (including meals and, to the extent necessary, lodging) to the place of employment will be provided, or its cost to workers reimbursed, by check separate from payroll, if the worker completes half the employment period. Return transportation will be provided if the worker completes the employment period or is dismissed early by the employer. In other words, if the worker completes 50% of the work contract period, employer will reimburse the worker for transportation and subsistence from the place of recruitment to the place of work by check separate from payroll.

 

Upon completion of the work contract period, or where the employee is dismissed earlier, the employer will provide or pay for the worker’s reasonable cost of return transportation and subsistence back home or the place the worker originally departed to work, except where the worker will not return due to subsequent employment with another employer.

 

The amount of transportation payment or reimbursement will be equal to the most economical and reasonable common carrier for the distances involved. Daily subsistence will be provided at a rate of $12.68 per day during travel to a maximum of $55.00 per day with receipts.

 

The employer guarantees to offer work for hours equal to at least three-fourths of the workdays in each 12-week period of the total employment period.

 

H-2B workers will be reimbursed in the first work week all visa, visa processing, border crossing, and other related fees, including those mandated by the government (excluding passport fees).

 

The employer will provide workers at no charge all tools, supplies, and equipment required to perform the job.
